Air Force, Viasat Reach Tentative SDA Bid Protest Resolution

The U.S. Air Force and Viasat have reached a tentative resolution in a months-long lawsuit concerning a SDA (Space Development Agency)-related contract award, court documents show.

Viasat filed a bid protest Sept. 23, 2024, against two contract awards for the SDA’s Tranche 2 Transport Layer (T2TL) Gamma effort. The parties have reached an agreement “in principle” on the material terms to resolve this matter, according to a joint status report filed April 1. The agreement still must be finalized and undergo the U.S. Justice Department’s internal approval process.

Viasat and the Air Force plan to file a joint status report regarding the negotiations by April 25, the parties wrote.

Viasat’s lawsuit alleged several of its competitors were assisted unfairly while bidding for the SDA’s T2TL program. York Space Systems and Tyvak International received contracts for the program on Aug. 16, 2024, for each to build 10 prototype spacecraft.

SDA since has terminated the agreement awarded to Tyvak International, and drafted and issued a new solicitation for those 10 spacecraft with responses due April 22. The agency authorized York Space Systems to continue work on its 10 awarded space vehicles.

Under the corrective actions, the Air Force also will choose a new source-selection official and advisory chair outside of the SDA for the new competition, at least until after that award decision is made.
